FOR IMMEDIATE RELEASE Thursday, July 23, 2020   CONTACT: Scott Robinson at 619-533-4586 or City of San Diego Offering Virtual Inspections for Permitted Construction Projects NEW VIRTUAL MEETING SERVICE PROVIDES CONTRACTORS WITH ALTERNATIVE TO IN-PERSON FIELD INSPECTIONS, ALIGNING WITH COVID-19 PHYSICAL DISTANCING AND SAFETY PROTOCOLS   SAN DIEGO – The City of San Diego Development Services (DSD) Department is expanding its residential and commercial inspection processes by offering optional virtual inspections for 23 common inspections for customer convenience while addressing COVID-19 risks and abiding by social distancing requirements. Earlier this year, DSD began piloting the virtual inspections and allowing customers to submit photos to inspectors of work conducted with no-plan Mechanical, Electrical and Plumbing (MEP) Permits .   No-Plan Simple MEP permits are issued for minor installations without the need to submit plans, including relocations of electrical outlets or rewiring of a unit and water heater replacements, among various minor installation and repair projects on existing buildings.   ”We’re making it easier than ever to build in San Diego by leveraging technology to help the construction industry get more shovels in the ground faster,” said Mayor Kevin L. Updated Construction Industry COVID-19 Safety Plan

The  Construction Industry COVID-19 Safety Plan has been updated to comply with the latest changes from the California Department of Public Health, Cal OSHA, and the County of San Diego.  The changes are highlighted in yellow. Construction remains an essential industry, and contractors have been effective in implementing safety measures to prevent the spread of COVID-19. This plan is a consolidation of best practices based on direction from health experts and firsthand experiences from construction safety professionals. This plan provides uniformity for contractors, workers, and owners working to protect construction personnel and the public. With greater consistency in approach, these safety measures will become more universal and effective. Pay-When-Paid Clause in Construction Subcontracts

A contract provision requiring a subcontractor to wait until the direct contractor concludes its litigation with the owner before it can seek payment on a payment bond was held unenforceable and against public policy in a recent appellate court decision, Crosno Construction, Inc. v. Travelers Casualty and Surety Company of America, 2018 WL 4183622 (Cal.App.4th). California law distinguishes between “pay-when-paid” clauses and “pay-if-paid” clauses. “Pay-if-paid” clauses were held unenforceable as against public policy by the California Supreme Court in the case of William R. Clarke Corp. v. Safeco Ins. In 1997. If a clause is merely a “pay-when-paid” clause, it is enforceable but only for a reasonable time. Once that time has passed the subcontractor must be paid. The subcontract clause involved in the Crosno case was as follows: “… Contractor shall have a reasonable time to make payment to subcontractor. Reasonable time shall be determined according to the relevant circumstances, but in no event shall be less than the time contractor and subcontractor required to pursue to conclusion their legal remedies against the owner or other responsible party to obtain payment, including (but not limited to) mechanic’s lien remedies.” The court ruled that enforcing the “pay-when-paid” provision found in

COVID-19 Update

We at ASA San Diego know there are many uncertainties right now and we are wishing everyone to stay healthy and safe as we navigate this environment together. In light of the recent CDC recommendations, ASA will be postponing all events and meetings with over 50 attendees until further notice. Unfortunately this includes our Sporting Clay event scheduled for March 20th and the Gulls game scheduled for April 1st. We are hoping to reschedule both of these events before the end of the year. However, if you’ve already paid for either event and would like a refund, please let me know. We will continue to monitor the situation and take recommendations from the CDC and State government.
