Bid Award Notifications

AB 1736 HAS MADE IT TO THE GOVERNOR’S DESK for signature, thanks to hard work and persistence by our lobbyist in Sacramento. This bill was introduced because contractors are not timely informed when they’re deemed to be the lowest bidder on a project. Notification delays of one month or more occur up to 68% of the time. This causes contractors — especially smaller ones — to postpone bidding other projects or raise prices on other bids while awaiting notification of the first bid. Per AB 1736, local entities shall develop policies to expedite the notification process by July 2020.

AB 1736

Why is AB 1736, aimed at assuring prompt notification of bid status, important? Our subcontractor members report that they’ve had to postpone bidding other projects or been forced to raise prices on other bids while awaiting notification of the first bid. Dynamex Ruling

Do you rely on independent contractors? Watch out! The California Supreme Court’s ruling in Dynamex Operations West, Inc. v. Superior Court of Los Angeles (Dynamex), along with the potential passing of AB5, may and probably will make it almost impossible to classify workers as independent contractors.
