OSHA has proposed delaying until December 1 the employer filing requirement under its new electronic recordkeeping rule. OSHA said the new compliance date will give employers extra time to review the provision and will allow for a public comment period. Some industry groups have noted that creating a public online database of injury data could reveal proprietary information about a company’s activities.

Saying good-bye to slow payments one step at a time: Assembly Bill 1223 just passed the full Assembly and now goes to the Senate, where it will once again be heard in at least two committees later this month. AB 1223 will greatly help subcontractors get paid timely, as it requires all State agencies to post online the payments they make to general contractors within 21 days of payment.

The core set of AIA Contract Documents have been updated based on industry trends and important court decisions. (This happens once every 10 years.) A401, the Standard Form of Agreement Between Contractor and Subcontractor, has a number of revisions. You can view additions and deletions on this document , thus comparing 2007 to 2017.

The Occupational Safety and Health Administration (OSHA) announced on May 17 that it will suspend the electronic recordkeeping rule’s filing deadline in order to give employers more time to comply. The original filing date was July 1, but OSHA has not yet opened the online portal that companies will use to submit their injury and illness logs. OSHA hasn’t announced how long the extension will last. Stay tuned.

They aren’t just asking to have the project be designed and constructed with BIM; they’re creating project specifications and turnover guidelines that are BIM-centric and that outline innovative BIM-enabled processes to successfully deliver their work. ASA-sponsored AB 1223 passed a critically important committee vote on April 26. This bill will require all public agencies to post on line all payments to general contractors within 21 days of payment. Subcontractors then would be able to see if the job they completed was paid for. Current law requires subs to be paid within seven days of the GC’s payment. Despite effective lobbying by opponents, we kept the bill alive. We did this by limiting the posting requirement to all state agencies, with local entities no longer impacted. While we know local entities are important… well, one step at a time. Getting a foot in the door is important. Now, if we are able to move AB 1223 out of the Appropriations Committee, and then off the Assembly floor, we will head toward the Senate for another set of hearings in a couple months. Our thanks go to ASA members who communicated their support in writing, on the phone, and in person to urge a YES vote. If you’re one of those… encourage others to follow your lead. Effective April 19, 2017, California Assembly Bill 210 is once again being enforced, and ready-mix suppliers must pay prevailing wages for the hauling and delivery of concrete on public works projects.

OSHA has announced a 90-day delay of the enforcement of its silica rule for the construction industry. The new deadline for compliance is September 23. On that date, construction employers must reduce workers’ allowed exposure to silica dust from the current limit of 250 micrograms per cubic meter over an eight-hour period to 50 micrograms. Employers are encouraged to take steps now to ensure compliance by the new enforcement date.

Kimberly J. Becker has been hired as the San Diego County Regional Airport Authority’s new President/CEO. She will begin in the position on May 1. She joins the Airport Authority as it is building a new Customs and Border Protection facility and planning the replacement of the 50-year-old Terminal 1.

California Assembly Bill 1223 will require that, within 10 days of making a construction contract payment, a state or local agency must post to its website the names of each construction contractor paid and the date and amount of the payment. Subcontractors can then know with certainty when they should expect their money, as existing law requires they be paid within five days.
